The gaming and gambling regulatory landscape is a mess. And for online operators where crossing geographical boundaries is no problem - it's even worse! In 2006 the UIGEA bill was hurried through and while being catastrophic for the industry at least clarified the issue of whether online gambling in the US was legal. It wasn't. Subsequently, the value of the industry plummeted as senior level executives were indicted, player numbers dropped significantly and investors lost faith in the industry.

Expansion of Europe

On paper the next best market was Europe where many operators already had significant traction. Whilst Asia – in terms of numbers of potential players – was the real goldmine if it could be cracked. However, these markets are tougher legal minefields than the US . Meaning that the next phase of gaming and gambling is a myriad of legal battles, unclear legislation and a distinct lack of harmonisation. At present the German market has 17 states with differing views on gambling legislation, the French market was a non-starter but has started to open up and the Italian market is on the up. Confused…so are we!

The future is bright…

However, the tide is turning and while the industry is still full of ambiguity and legal loopholes, the efforts of the gaming & gambling industry and the European Commission has seen gains in the last 12 months with Placanica and Ze Turf cases. In fact there are more cross border cases than ever before with letters sent to among others Denmark , Hungary , Finland , Italy , France and Germany . And with the EC seemingly onside to protect Community Law and the Freedom of Services the future is bright.

Preparing for battle!

But it won't be easy. National monopolies are - unsurprisingly – not keen on opening their borders and allowing competition in. They make literally millions of Euros each year from their current operations and will be fighting hard to ensure they keep hold of their profits. Add to this the fact they know exactly what they are doing in terms of lobbying and fighting court cases and the gaming industry is up against formidable opposition whom for everyday they extend their stay of execution is another stack of Euros in the till!

Delivering a robust legal framework

It's quite clear that the 27 member states led by the EC need to harmonize and liberalise to ensure a pan-European gaming and gambling community can thrive. Indeed, the industry wants a robust, formal, regulatory framework that makes it easier for everyone and provides the clarity so desperately wanted. It's a confusing landscape though with a thousand challenges. To get the inside track on the current position of the European Commission, the cases that have been brought against member states and the outcomes - or progress of - cases currently going through the courts in countries such as Holland, Germany, France, Spain… and for that information you must attend the 2 nd annual Legal Gaming in Europe Summit!
